Please read these Terms and Conditions carefully before using the Capital Wallet platform. By creating an account or using our services, you agree to be bound by these terms.
1. About Capital Wallet
Capital Wallet is a Crypto-Asset Service Provider (CASP) licensed and regulated under the EU Markets in Crypto-Assets Regulation (MiCA — Regulation (EU) 2023/1114). Our services are currently available exclusively to residents of the European Union (EU) and the European Economic Area (EEA).
Capital Wallet provides custody and transfer services for crypto-assets. We do not provide investment advice, financial planning services, or tax advice.
2. Eligibility
To open and use a Capital Wallet account, you must:
- Be at least 18 years of age.
- Be a resident of an EU or EEA member state.
- Successfully complete our identity verification (KYC) process.
- Not be subject to any applicable sanctions or restrictions.
3. Account Registration and Verification
When you register for an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
We are required by law to verify your identity before you can use our services. This includes collecting government-issued identification documents and other personal information as part of our Know Your Customer (KYC) and Anti-Money Laundering (AML) obligations.
4. Permitted Use
You agree to use Capital Wallet only for lawful purposes. You must not:
- Use the platform to facilitate money laundering, fraud, or any other illegal activity.
- Attempt to gain unauthorised access to our systems or another user's account.
- Use the platform in a manner that could damage, disable, or impair our services.
- Misrepresent your identity or provide false information during registration or KYC.
5. Crypto-Asset Risks
Crypto-assets are highly volatile. The value of your crypto-assets may increase or decrease significantly, and you may lose part or all of the amount you deposit. Past performance is not indicative of future results.
Capital Wallet does not guarantee the value of any crypto-asset and is not liable for any losses arising from market movements, network failures, or other events outside our control.
6. Fees
Details of our current fee schedule are published on our website and within the platform. We reserve the right to update our fees with reasonable notice. Continued use of the platform after a fee change constitutes acceptance of the updated fees.
7. Account Suspension and Termination
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, if required to do so by applicable law, or if we determine that continued use poses a risk to Capital Wallet or other users.
You may close your account at any time by contacting our support team. Upon closure, any remaining crypto-asset balances will be transferred to a wallet address you provide, subject to applicable withdrawal procedures.
8. Intellectual Property
All content, branding, and technology on the Capital Wallet platform is the property of Capital Wallet or its licensors. You may not copy, modify, distribute, or create derivative works without our express written permission.
9. Limitation of Liability
To the fullest extent permitted by law, Capital Wallet shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of crypto-assets, loss of data, or loss of profits.
Our total liability to you for any claim arising out of or relating to these Terms or your use of the platform shall not exceed the amount of fees paid by you to Capital Wallet in the 12 months preceding the claim.
10. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the European Union and the applicable laws of the jurisdiction in which Capital Wallet is incorporated. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or via a notice within the platform. Your continued use of Capital Wallet after any changes constitutes your acceptance of the updated Terms.
